Terms of use

This English version is a translation provided for information. The Spanish version is the one that applies and prevails in case of discrepancy. The portals are in Spanish and are intended for people living in Spain.

1. Parties and purpose

These terms govern the use of the service that DATAGROWT SYSTEMS, S.L. (“DataGrowt”), tax ID B27650928, with the other details in the legal notice, provides through tellamamos.es and its portals (“the Portals”) to the people who use them.

2. What the service is and is not

The service consists of collecting and verifying your request so that the companies in the Portal’s sector that you authorise (“recipient companies”) contact you and present their proposal.

DataGrowt does not:

• sell or contract alarms, insurance, energy, telecoms, renovation or any other product or service;
• act as a security company, insurer, insurance intermediary, supplier or operator;
• advise on, recommend or rank products or companies;
• guarantee the terms, availability or outcome of the proposals.

Any contract is entered into directly between you and the company, under its terms. You are not obliged to sign up for anything.

3. How it works

1. You answer a few questions about what you need and give us your contact details.
2. Before sending, you can view the Portal’s list of recipient companies, with their name, tax ID and privacy policy, and decide whether to authorise them to contact you.
3. We send you a code by SMS, from the sender “TeLlamamos”, to confirm that the phone is yours. Without that code the request is not sent to anyone.
4. We pass your request on to the companies you have authorised.
5. The companies contact you through the channels stated in the checkbox you accepted, within legal hours.
6. Your authorisation expires after 12 months, and you can withdraw it earlier whenever you like.

The service is free for you.

5. Recipient companies

Each Portal’s list of companies is at its /cesionarios address. The version in force when you gave your authorisation applies to you and is recorded with it. If a company is added later, it will not receive your data without a new authorisation from you.

DataGrowt contractually requires each company to:

• use your data only to present its proposal for the Portal’s sector and through the authorised channels;
• not pass your data on to or sell it to anyone;
• identify itself when contacting you and tell you where your data came from;
• comply with the hours and rules on sales calls;
• act on your opt-out immediately.

Each company is responsible for its proposals, its communications and the contracts it enters into with you.

6. Requirements

To use the service you must be over 18, live in Spain and provide your own data.

7. Your obligations

• Provide accurate, up-to-date data.
• Do not enter other people’s data (relatives, acquaintances or companies), even if you think they may be interested.
• Do not use bots or send false or bulk requests.

If these obligations are not met, DataGrowt may refuse to process the request or cancel it.

8. Permission to contact you and opting out

Accepting these terms does not authorise anyone to contact you. You give that authorisation, if you wish, in a separate unticked checkbox, and it is governed by the Privacy policy.

You can withdraw it whenever you like, for all companies or just some, at no cost and without giving reasons:

• on Your data;
• by writing to privacidad@datagrowtsystems.com.

We tell the companies that received your data within 2 working days. Withdrawal from contracts you sign with a company is governed by that contract and by law.

9. Liability

DataGrowt is responsible for providing the service described with due care. It is not responsible for the companies’ proposals, terms or contracts, or for damage caused by false or third-party data entered by whoever uses the Portal. These limitations apply to the extent permitted by law and never exclude liability for wilful misconduct or gross negligence or limit consumers’ rights.

10. Support and complaints

You can submit any complaint to hello@datagrowtsystems.com or by post to the address in the legal notice. We will reply within 15 working days. You can also contact the consumer services of your region or town council in Spain.

11. Changes to these terms

If we change them significantly, we will announce it on tellamamos.es at least 15 days in advance. Changes do not affect requests already sent. Each version has a number and a date.

12. Applicable law and jurisdiction

These terms are governed by Spanish law, without prejudice to the mandatory rules that protect you as a consumer. You may bring proceedings before the courts of your place of residence. If any clause is void, the others remain in force.

Annex · Sector-specific terms

Alarms and security

Security systems are installed and provided by the security company that contacts you. DataGrowt does not install, sell or monitor alarms and has no alarm receiving centre.

Insurance

DataGrowt only passes your contact request on to the insurers or insurance intermediaries you authorise. It does not present, rank or recommend insurance, gives no information on its financial terms and takes no part in the contract. The insurer or intermediary will give you the mandatory pre-contractual information.

Home renovation

Works, quotes and guarantees are the responsibility of the renovation company that contacts you. DataGrowt does not carry out works, prepare quotes or advise on renovation. The indicative amounts shown on the Portal are not a quote. If you rent, you will need the owner’s permission to carry out works.

Solar panels

Installations are carried out by the installers that contact you. DataGrowt does not install panels, does not sell electricity and is not an energy supplier, and gives no production or savings figures: each company will make its own calculation.

Other sectors

When a new Portal opens (fibre and mobile, NGOs, tarot or others), its specific terms will be added here before it starts collecting requests.
